Through a unattributed decision, the nation's top court has allowed Texas to implement a revised congressional boundary scheme that may create up to five additional GOP-friendly districts. The six-to-three ruling, released on Thursday, upholds a appeal by the state to set aside a federal judge's injunction that had rejected the boundaries in November.

Justices' Explanation

The federal judge wrongly interjected itself into an ongoing primary campaign, creating much confusion and upsetting the sensitive balance of power in elections, the order stated in explaining its action.

The district court had determined that Texas had likely grouped voters based on their race – a method known as racial gerrymandering – when it passed the redistricting plan. It had instructed the state to employ the boundaries drawn after the 2020 census for the forthcoming election.

Sharp Opposition

In a forcefully written dissenting opinion, Justice Elena Kagan objected to the court's action. She argued that it undermined the work of the lower court, observing that its decision was crafted by a judge selected by former President Donald Trump.

While our court is superior in jurisdiction, we are not superior in making these fact-intensive determinations, Kagan stated in a opinion supported by Justices Sonia Sotomayor and Ketanji Brown Jackson.

Kagan added, Today's ruling ensures that Texas's new map, with all its boosted favoritism, will control next year's elections. And it means that many Texas citizens, for no good reason, will be placed in electoral districts because of their race. And that result, as this court has stated repeatedly, is a violation of the U.S. Constitution.

National Redistricting Fight

The court's action occurs during a national fight over the remapping of electoral maps. Texas is a crucial component in efforts to transform the U.S. House map to secure a slim Republican hold. Tonight's ruling by far-right justices on the supreme court is further proof that the extremists will do anything to rig the midterm elections. The gerrymandered Texas congressional map is a partisan and racially discriminatory power grab designed to subvert the will of the voters – particularly in Black and Latino communities, he stated.
