Federal Court Mandates Freedom of Kilmar Abrego Garcia from ICE Detention
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without lawful basis.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.
The case originates in a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to answer alien smuggling allegations, he was held in federal custody.
In her order, the judge noted that the government does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
